By creating an account or using any part of the MarketingAI service, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization.
MarketingAI provides an AI-powered platform for generating advertising creatives, product photoshoots, ad copy, and related marketing materials ("Service"). Features may vary by subscription plan and are subject to change with reasonable notice.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at contact@marketingai.ink of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your login information.
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
Subject to your subscription plan, you retain ownership of the output creatives you generate using the Service for commercial use. MarketingAI retains all rights, title, and interest in and to the Service, including the underlying technology, platform, and any improvements thereto. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
Paid plans are billed in advance on a monthly, quarterly, or annual basis. All fees are non-refundable except as required by applicable law or as expressly stated in our refund policy. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We reserve the right to suspend or terminate your account at any time if you violate these Terms, with or without prior notice.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by applicable law, MarketingAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to your use of or inability to use the Service. Our total cumulative liability to you shall not exceed the amounts paid by you to us in the three months preceding the claim.
You agree to indemnify, defend, and hold harmless MarketingAI and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
These Terms are governed by and construed in accordance with applicable law. Any dispute arising from these Terms shall be resolved through binding arbitration or in competent courts, as determined by applicable law.
We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitute your acceptance of the revised Terms.
